General Terms
The is an agreement between Izabela Couture and the customer stated below.
Izabela Couture will fulfil all obligations as outlined in the quote and deliver the order by the specified date, unless exceptional unforeseen circumstances prevent this from happening (e.g. serious injury or illness, bereavement, fire damage, theft or failure of timely delivery by suppliers). Should any of these circumstance occur, Izabela Couture will inform the customer as soon as possible.
The customer is expected to provide all the information required to fulfil this work, update Izabela Couture should there be any changes and maintain an open communication channel so any changes in the project can be easily and quickly relayed. A failure to do this may result in a delay in the project.
Though every care has been taken to ensure the quote covers all the requirements of the customer, it is the responsibility of the customer to check the quote includes all the items and elements they need before signing.
Fittings
The customer will be invited to a design consultation meeting at Izabela Couture studio/any place agreed upon beforehand, to discuss their ideas and requirements.
The customer agrees to attend following:
toile (mock-up) fittings (max 2),
fabric fittings (max 2),
a final fit upon collection.
Additional fittings can be requested at additional cost. If requested by Izabela Couture, no additional fees will be levied.
Should the customer require home or onsite visits for the design consultation and fittings, travel expenses will be agreed beforehand and added to the final invoice. Fittings will be arranged at the convenience of Izabela Couture and the customer. Should the customer need to cancel a fitting appointment they must inform Izabela Couture as soon as possible. A new fitting will be arranged but any delay in the completion of the order due to a cancelled/postponed appointment by the customer is not the fault of Izabela Couture, and every effort will be made to complete the order by the agreed deadline. If Izabela Couture has travelled for the fitting which has been missed or cancelled the travel expenses and cost of fitting will be invoiced.
Design changes can be made at the toile fitting, but once this design has been agreed changes are at the discretion of Izabela Couture.
Major alterations to a garment due to weight loss or gain will incur extra work which will be charged accordingly.
The customer is advised to wear the shoes and undergarments they wish to wear with the outfit at the fittings, as changes cannot be made once the hem length and fit is agreed on.
Upon collection the customer will try on the garment to ensure the fit is perfect. Any requests for minor alterations must be made known as soon as possible, as once the garment and final payment have been exchanged, any further work will come at an additional cost and be completed only when and if possible.
Price and Payment
The price for the goods shall, unless otherwise agreed, be the price set out at the time of the initial consultation.
Izabela Couture reserves the right to make an additional charge for last minute or repeatedly cancelled / postponed meetings at a rate of £350 per day.
A deposit of 50% of the order value shall be paid up front. Work will not commence until the customer has approved the design proposal and payment of the deposit has been paid. The remaining balance is payable at the final fitting.
The It is understood that the initial deposit is wholly non-refundable.
Payment can be made by cheque, bank transfer or PayPal. Payment shall not be deemed to have occurred until we have received cleared funds.
Any additional charges unknown at the time of the undertaking of work, for example shipping costs, will be charged at the time when such fees are understood. These charges will be applied at the rate of the third-party supplier costs.
Cancellation Policy
The customer can cancel at any point up to, and including, the toile fitting. The deposit will not be return to the customer, however.
Once construction has started in the final fabric, cancellation is not possible and the full payment is expected due to the bespoke nature of the garment(s).
When fabric has been bought, should the customer wish to change it, the additional cost of the new fabric will be added to the final invoice. Note: changes cannot be made once the fabric has been cut without incurring an extra charge for cutting in addition to the new fabric.
To cancel an order, the customer must inform Izabela Couture of such cancellation in writing and await its acceptance.
Warranties
Izabela Couture warrants that the goods are of satisfactory quality.
The customer should wish to make a claim under this warranty, they shall give written notice within 30 days of the delivery of the goods.
Our liability under the warranty shall be limited to repairing or replacing the goods in question.
Return
The process that we follow, at the customer’s instruction, is one involving careful consideration and selection of cloth and design, Izabela Couture shall therefore only accept returns for goods which are damaged or defective prior to final sign off.
It is the customer’s responsibility to check the goods thoroughly prior to signing them off.
No refund or replacement can be made after the goods are signed off.
Photography
Photographs might be taken throughout the construction of the goods.
The pictures taken during the fittings will only be shared on social media in whole, or in part, with customer’s permission.
Izabela Couture maintains the right to take a picture on completion of the goods on a mannequin to feature on her website. Further images of the customer in the outfit will be requested to feature on the website/social media with their permission.
Data Protection And Privacy
Where we collect customer’s personal data it will only be used in accordance with the Data Protection Act 1998.
Izabela Couture shall not share the customer’s data with any third party. We may use this data to contact you for any future marketing, advertising, and promotional purposes.
The customer has the right to ask for a copy of the information we hold, to correct any inaccuracies or to destroy it.
